Texas Affidavit of Heirship Easy Intake

An Affidavit of Heirship can act as nonjudicial evidence of ownership per the Texas Estates Code section 203.001, avoiding the need to go through probate. When determining heirs for an individual who died intestate (without a Last Will & Testament), you can complete the intake form to help you understand the Texas Estates Code section 201.001 Descent and Distribution.  Although the Texas Estates Code does not require additional people to sign (disinterested witness), many Texas title companies do so it has been added as a field, but you can skip through it if you don't need.

A completed affidavit of heirship does not transfer property but serves as evidence of heirship according to Texas law, potentially helping you avoid probate.
